Agreement
These Terms of Service ("Terms") govern your access to and use of the TREAL Office Management Solution, including the SM-OMS mobile application and web platform at oms.smartmux.com (collectively, the "Service").
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility & Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity that occurs under your account.
If you use the Service as an employee of an organization, your use may also be subject to your employer's internal policies and administrator controls.
Permitted Use
You agree to use the Service only for lawful business purposes. You may not:
- Violate applicable laws, regulations, or third-party rights.
- Attempt unauthorized access to systems, accounts, or data.
- Interfere with or disrupt the Service, servers, or networks.
- Upload malicious code or misuse attendance, leave, expense, or approval features.
- Misrepresent your identity, role, or affiliation within an organization.
- Reverse engineer, decompile, or copy the Service except where permitted by law.
Organization Accounts
If your organization subscribes to TREAL, administrators may create and manage user accounts, permissions, and business data within the Service.
Your organization is responsible for how it configures and uses workforce features such as attendance, leave, payroll, expenses, and approvals, including ensuring appropriate internal authorization and compliance with applicable employment laws.
User & Organization Data
You and your organization retain responsibility for data submitted to the Service, including employee records, attendance logs, expense receipts, and other business content.
You grant TREAL a limited license to host, process, and display such data solely to provide and improve the Service on your behalf.
Subscriptions & Payments
Paid plans, billing cycles, renewals, upgrades, downgrades, and refunds are governed by the plan selected by your organization and any checkout terms presented at the time of purchase.
Failure to maintain an active subscription or valid payment method may limit access to paid features.
Mobile App License
Subject to these Terms, TREAL grants you a limited, non-exclusive, non-transferable, revocable license to install and use the SM-OMS mobile application on devices you own or control for authorized business use of the Service.
You may not copy, modify, distribute, sell, or lease any part of the mobile application except as expressly permitted by these Terms or applicable law.
Intellectual Property
TREAL and its content, features, software, branding, and design are owned by us or our licensors and are protected by applicable intellectual property laws.
These Terms do not grant you ownership of the Service or any associated intellectual property rights.
Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer
The Service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
TREAL is a software platform. We do not provide legal, tax, accounting, or employment advice. Your organization remains responsible for its business and compliance decisions.
Limitation of Liability
To the maximum extent permitted by law, TREAL and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the Service.
Termination
We may suspend or terminate access to the Service if you violate these Terms, create security or legal risk, or if required to do so by law.
You may stop using the Service at any time. Provisions that by their nature should survive termination will remain in effect.
Changes
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date.
Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
